Pune: Osho followers to move HC over order on bids for 2 plots

PUNE: A section of disciples of Osho Rajneesh has decided to move the Bombay high court against the charity commissioner’s order of October 10 this year, inviting fresh offers for the sale of two plots held by the Osho International Foundation (OIF), a registered charitable trust, in Koregaon Park.

“We will challenge the order as there is no clarity on what basis the bids have been invited considering an earlier high court directive restraining the creation of any third party interest in the said properties,” Sunil Mirpuri alias Swami Yoga Sunil, a disciple and an intervention Lawyer, told TOI on Sunday.

A public notice relating to the charity commissioner’s office was recently published in some newspapers. “Our application for the cancellation of an earlier MoU between the OIF and a prospective buyer and refund of Rs50 crore deposit is also pending before the joint charity commissioner,” Mirpuri said.

In March last year, the OIF had first initiated the bid to sell the two plots – admeasuring 9,836.20sqm together with a bungalow and 4,032.56sqft – citing a financial crunch, and even found a buyer who placed an Rs107 crore bid for them. According to the charity commissioner’s latest public notice, the invited offers cannot be less than Rs107 crore.

The notice read, “Unconditional written sealed offers from the public has been invited to assign/sale/transfer of property of the OIF within 30 days from publication of the notice.”

When contacted, Ma Amrit Sadhana, spokesperson and one of the trustees of the OIF, told TOI, “This matter has been going on since January 2021 and the notice is published as per the directions of the charity commissioner. There is nothing illegal about it and we are following the department’s orders in this regard. This second notice published is in continuation of the first bid. The charity commissioner’s office feels that the trust should benefit from this bid.”

A schedule of property mentioned in the notice reads: “All the piece or parcel of government leasehold plots of lands bearing city survey no. 15 and city survey no. 16 aggregating to 11,764 square yards i.e. 9836.20 square metres together with bungalow and other structures admeasuring 4032.56 square feet standing thereon situated at village Koregaon Estate, Koregaon Park within the limits of the , registration district Pune.”

The Hon’able Joint Charity Commissioner-I, Maharashtra State Mumbai, Dharmadaya Ayukta Bhavan, 2nd Floor, Sasmira Building, Sasmira Road, Worli, Mumbai 400030 has passed order dates 10th October 2022 below Ex.1 in application no. 2 of 2021 and directed to invite unconditional written sealed offers from public to assign/sale/transfer of property of the “Osho International Foundation”, having trust registration No. F-14570 (Mumbai) on “AS-IS-WHERE-IS” and “AS-IT-IS-BASIS” specifically mentioned in schedule written hereunder within 30 days from publication of this notice.

The Offer should be submitted along with 50% as an earnest money by way of demand draft/pay order of total offer amount in the name of “Osho International Foundation”. The Ld Joint Charity Commissioner – I, Maharashtra State, Mumbai reserves all rights to accept or reject the offers. The decision of the Ld. Joint Charity Commissioner – I, Maharashtra State, Mumbai in respect to accept or reject the offer shall be binding on all offerings.

Offers may be submitted on any working days between 10 am to 3 pm in the office of the Charity Commissioner, Maharashtra State, Mumbai.

The received sealed offers will be opened in the open court hall on 15/11/2022 at 11 am at the address mentioned above in the office of the Ld. Joint Charity Commissioner – 1, Maharashtra State, Mumbai. The presence of the bidders in person is mandatory on the specified date before the Hon’able Joint Charity Commissioner-1, Maharashtra State, Mumbai to rule out any complications of whatsoever nature.

In the said matter, one person has already given offer of Rs. 1,07,00,00,000 (Rs. One Hundred and Seven Crores only). Hence no offer should be submitted below the said amount.
